Terms of Service

Calling Round Pty Ltd, ABN 95 697 108 900, Suite 122, 283 Glen Huntly Road, Elsternwick VIC 3185 ("Calling Round," "we," "us").
1. About these terms
These terms govern your use of the Calling Round website and consumer companion calling service. You may sign up to receive calls yourself, or enrol another adult such as an older family member, as set out in clause 4. By signing up or using the service, you agree to them. Use of Calling Round by aged care providers and other organisations is governed by a separate written services agreement, not these terms.
2. What Calling Round is, and is not
Calling Round provides friendly, automated companion phone calls delivered by an AI voice assistant (Ray or Rose), and shares summaries and key points from those calls with the people you nominate. Calling Round is not a medical, health, healthcare, monitoring, diagnostic, or emergency service, and is not a substitute for professional medical care, aged care, or human supervision. We do not provide medical advice, diagnosis, treatment, monitoring, or emergency response. In an emergency, or if someone needs urgent help, call 000 immediately.
3. Eligibility and accounts
You must be at least 18 years old to create an account and agree to these terms. You agree to provide accurate information and to keep your account secure.
4. Enrolling another person
You may sign yourself up to receive calls, or enrol another adult (the "call recipient"), such as an older family member. If you enrol someone else, you confirm that either the recipient has agreed to receive recorded calls made by an AI service and to summaries being shared with nominated contacts, or you are their authorised representative or substitute decision-maker with authority to consent on their behalf. You confirm you have told the recipient that the calls are made by an AI, that they are recorded, and that summaries and key points are shared with the contacts you nominate. At sign-up you must tick a box confirming this. You are responsible for the accuracy of the information you provide about a recipient, and for telling us promptly if your authority changes.
5. The calls
You choose the days and times for recurring calls. The calls are made by an automated AI system, not a live person, and the assistant identifies itself as an AI. You or the recipient can change call times or stop the calls at any time. Call delivery depends on telephone networks and other factors and cannot be guaranteed.
6. Recording and consent
Calls are recorded and transcribed. On the first call, the assistant explains that calls are recorded and that summaries and key points will be shared with your nominated contacts, and asks the recipient to confirm. That verbal consent is captured and covers both that call and future calls. We do not ask for confirmation before each call. Consent to recording is necessary to use the service, and the recipient can withdraw it and stop the calls at any time.
7. How we use what is discussed
We use call recordings and transcripts to deliver the service, to write call summaries and extract key points to share with the family members or contacts you nominate, to review and maintain quality, and to improve, develop, and train our services and the AI models that power them. Our handling of personal information is described in our Privacy Policy.
8. Fees and billing (consumer)
Current subscription pricing is shown at sign-up and on our website. Payments are processed through Stripe. You can cancel at any time, and on cancellation we provide a refund of the current month's fee. We may change our subscription pricing. Any price change takes effect only from the start of your next monthly renewal period, and we will give you notice before it applies, so you can cancel before the new price takes effect.
9. Acceptable use
You must not use the service for unlawful purposes, to harass any person, in place of emergency or medical services, or in any way that could harm a call recipient. You must not enrol a person without the authority described in clause 4.
10. Safety
Calling Round is not for emergencies. If a recipient signals they may be at risk of harm, the call is designed to direct them toward human help. This is a safety feature, not a monitoring or clinical service, and does not replace emergency services or professional care.
11. Intellectual property
We own the Calling Round platform, software, and brand. You retain your rights in the information you and the recipient provide and share on calls, and you grant us a licence to use that information for the purposes described in clause 7 and the Privacy Policy.
12. Disclaimers
The service is provided "as is." To the extent permitted by law, we exclude all warranties not expressly stated. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to a remedy under that law and to compensation for reasonably foreseeable loss. For a failure that is not major, we are entitled to remedy it within a reasonable time, and if we do not, you may cancel and obtain a refund of the unused portion.
13. Consumer guarantees
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, and nothing in these Terms limits or excludes them.
We guarantee that our services will be provided with due care and skill, will be reasonably fit for any purpose you have told us about, will be supplied within a reasonable time, and that we have the right to supply them.
If we fail a consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law. For a major failure you may cancel and obtain a refund for the unused portion, or seek compensation for the drop in value. For a failure that can be fixed, you may ask us to remedy it within a reasonable time, and if we do not, you may cancel and obtain a refund for the unused portion.
Where the law allows us to limit liability for a failure to meet a guarantee (other than one that cannot be limited), our liability is limited, at our option, to supplying the services again or paying the cost of doing so.
14. Limitation of liability
To the extent permitted by law, and subject to the Australian Consumer Law, our total liability arising from the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss, or for any reliance on the service as a medical, safety, or monitoring service.
15. Suspension and termination
We may suspend or end access for breach of these terms or where required by law. You may stop using and cancel at any time.
16. Changes
We may update these terms and will give reasonable notice of any material change. If you do not agree to a change, you may cancel at any time before it takes effect at no cost, and it will not apply to you if you cancel. Continued use after a change takes effect means you accept it. This clause does not limit any right you have under the Australian Consumer Law.
17. Governing law
These terms are governed by the laws of Victoria, Australia, and you submit to the courts of that jurisdiction.
